TERMS AND CONDITIONS OF USE

1. WHO WE ARE

American English Sounds: ("the App") is published by smooth-english.com
("we", "us"). You can reach us at netloma@yahoo.com.

By downloading or using the App you agree to these Terms. If you do not agree
to them, please do not use the App.

2. WHAT THE APP DOES

The App teaches the pronunciation of American English sounds. It provides
recorded words and phrases, written lessons, listening exercises, and practice
activities that use your device's speech recognition to compare what you say
with the word or phrase on screen.

The App is a learning aid. We do not promise any particular result, score,
test outcome, or change in how you are understood by other people.

3. FREE PERIOD

The App may be used in full for three (3) days from the first time it is
opened on your device. When those three days have passed, continued use
requires a paid subscription.

This free period is provided by the App itself. It is not an Apple
introductory offer, it is counted from first launch on a given device, and it
is offered once.

4. SUBSCRIPTIONS

4.1 What is offered

  - Monthly subscription: USD 2.99 per month, giving access to all of the
    App's content and activities for one month.

  - Yearly subscription: USD 19.99 per year, giving access to all of the
    App's content and activities for one year.

Prices shown in the App are the prices that apply to you. They are set by the
App Store for your country and currency and may differ from the figures above,
which are given in US dollars. Prices may change; we will tell you before a
change affects you, and the App Store will ask you to agree to any price rise
before it is charged.

4.2 Payment

Payment is charged to your Apple ID account when you confirm the purchase.

4.3 Automatic renewal

Subscriptions renew automatically. Your Apple ID account is charged for the
next period within 24 hours before the end of the current period, at the price
then in effect, unless automatic renewal is turned off at least 24 hours
before the end of the current period.

4.4 Managing and cancelling

You can manage your subscription and turn off automatic renewal in your Apple
ID Account Settings at any time after purchase. Turning off automatic renewal
stops the next charge; it does not shorten or refund the period you have
already paid for. There is no cancellation of the current subscription during
an active period.

4.5 Refunds

Purchases are handled by Apple, so refunds are Apple's to give, under the
Apple Media Services Terms and Conditions. We cannot issue refunds directly.

5. WHAT YOU NEED

The App requires a compatible Apple device, iOS 15.0 or later, and an internet
connection to make or restore a purchase. Recorded audio is stored in the App
and plays without a connection.

Speech recognition and microphone access are optional. The practice activities
that listen to you will not work without them; everything else will.

6. YOUR RECORDINGS AND YOUR PRIVACY

The App records your voice only while a practice activity is listening, and
only so that your speech can be compared with the word or phrase on screen.
Speech recognition is performed by Apple's speech recognition service, which
may send audio to Apple for processing. We do not keep your recordings and we
do not send them to our own servers.

7. WHAT YOU MAY AND MAY NOT DO

The App and everything in it - the recordings, lesson text, exercises and
artwork - belongs to us or to our licensors, and is licensed to you for your
own personal, non-commercial learning. You may not copy, redistribute, resell,
publish, or make the recordings or lessons available to others, whether free
or for payment, and you may not use them to build or train another product or
service.

8. AVAILABILITY

We try to keep the App working and available, but we do not guarantee that it
will be uninterrupted or error-free. We may change, suspend, or discontinue
any part of it. If we discontinue the App entirely while you hold a paid
subscription, you may be entitled to a refund of the unused part through
Apple.

9. LIMITS ON OUR LIABILITY

To the extent the law allows, the App is provided "as is", and we are not
liable for indirect or consequential loss arising from your use of it. Nothing
in these Terms limits liability that cannot be limited by law, including
liability for death or personal injury caused by negligence, or for fraud.

Nothing in these Terms affects the statutory rights of a consumer.

10. CHANGES TO THESE TERMS

We may update these Terms. The current version is always the one published at
https://www.smooth-english.com/terms, and the date at the top shows when it
last changed. If a change materially affects your subscription, we will tell
you before it takes effect.

11. APPLE

Apple is not a party to these Terms and is not responsible for the App or its
content. Apple has no obligation to provide support for the App. Apple is a
third-party beneficiary of these Terms and may enforce them against you.

12. GOVERNING LAW

These Terms are governed by the laws of the State of California, USA,
without regard to its conflict-of-law rules.
